What does certified translation mean?

Certified translation

Certified translation (e.g. sworn, forensic, official translation, translation with translator’s clause or translation certified by court appointed translator) consists of a document in the default language and its translation into the target language. Certified translation must be physically bound (by the colored-string and stamp attached) with the source text, either with an original document or with its authenticated copy. The translator’s clause, equipped with the round seal of the certified translator as appointed by the Ministry of Justice of the Czech Republic, must be affixed to these documents. The certified translator confirms by his/her signature that the translation corresponds to the text of the attached document. The translator’s clause must be written in the same language as the translation therefore such document may also be used for foreign authorities.

Purpose of certified translation

Certified translations are necessary for officially required documents if the language of the required documents differs from the language of the original document. The documents may be required:

  1. By state administration bodies and by investigative, prosecuting and adjudicating bodies of the Czech Republic (courts, prosecuting attorney’s offices, the Police)
  2. By various authorities and institutions, e.g. schools, universities, etc.

Formal elements of certified translation

Certified translation must always be equipped with the translator’s clause of the certified translator and with the imprint of a round seal with the lesser coat of arms of the Czech Republic, both verifying that it is a true and accurate translation of the original text and that the content corresponds to the original document. Certified translation fulfills the requirements and demands of the government bodies of the Czech Republic for translation of foreign language documents for the purposes of official acts. Abroad, it fulfills conditions for translation of Czech official documents required by relevant authorities of the given country. In the event of communication between companies or private persons, certified translations guarantee the correctness of translation of the foreign language documents to the relevant language, which is important, for example, for contract-based, legally binding documents. The relevant document in the source language in the form of the original, or its authenticated copy, must always be affixed to the certified translation. The authentication clause must also be translated.

Legalization / Super legalization

Based on the content of international conventions, in certain cases there is a requirement to carry on a “higher degree” verification, so called legalization or super-legalization. Legalization means official authentication of a signature on the relevant document; super legalization means an extra clause guaranteeing the foreign language document was verified or issued by the authorized person. Translation may also be equipped with the Apostille (Convention de La Haye du 5 Octobre 1961) proving the authenticity of the stamp and the signature on the document necessary for use abroad. If it is so stipulated by the international contract, super legalization may, in special cases, be substituted by the Apostille.
